Divorce and seperation are never easy. It is made even more difficult and complicated when children are involved.

When parties want to obtain a divorce or become seperated, and there are children born of the marriage or seperation, it is required by law that a parenting plan is drawn up between the parties to regulate the rights and responsibilities of the parties in respect of the children.

What is a Parenting Plan?

A Parenting Plan is a unique, written agreement between parents, that sets out how each parent will exercise their rights and responsibilities in respect of the children upon divorce or seperation.

The aim of the Parenting Plan is to reduce conflict between the parents by setting out clear guidelines and managing the expectations of each parent in the Parenting Plan. In the Parenting Plan, the best interest of the children are of paramount importance.

The Parenting Plan will deal with a number of aspects in relation to the children, such as:

  • with which parent the children will reside;
  • the right of access and contact to the children by either parent;
  • how decisions will be made in respect of the children;
  • maintenance of the children;
  • schooling and religion;
  • medical decisions in respect of the children;
  • dispute resolution procedures;

It is best to have your Parenting Plan drawn up by a lawyer, social worker or Psychologist.
